Brazil Quadruples Penalties for Biological Weapons Development

PGA member and Chair of Brazilian National Group, Dep. Jean Wyllys, acknowledged the Presidential Decree of May 11th, 2016 that, inter alia, quadruples penalties for development of biological weapons.

PGA was pleased to have been informed by Dep. Jean Wyllys, PGA Member and Chair of the Brazilian PGA National Group that, on May 11th, 2016, the Office of the President of Brazil issued Decree n.8772 that regulates Law No. 13,123 , of May 20, 2015. This Decree, inter alia, quadruples penalties for development of biological weapons.

Dep. Jean Wyllys said:

As a parliamentarian, I am glad to see the publication of the presidential decree n. 8772 of 11 May 2016, where it is specified in the 2nd paragraph of Section III Art.79 - Of the offenses against the genetic heritage and associated traditional knowledge, that:

If the consignment is carried out for the development of biological or chemical weapons, the penalty provided for in the caput will be quadrupled and should apply the embargo sanctions, suspension or partial ban or total establishment, activity or project, the responsible for the consignment.

By applying these changes to existing law, Brazil sends an important message at national and international level that despite the Biological Weapons Convention being 40 years old, given the constant threats from different groups to obtain and develop biological weapons, it is of paramount importance that States Party to the Convention revise their legislation in order to ensure that such mechanisms are up to date and such practices do not come to happen.

I encourage not only the Brazilian government, but all other Latin American States to continue its review of laws related to the Biological and Toxin Weapons Convention.

Como parlamentar, me alegro em ver a publicação do decreto presidencial n. 8772 de 11 de Maio de 2016, onde especifica-se no 2º paragrafo do Art.79 da Seção III - Das infrações contra o patrimônio genético e conhecimento tradicional associado, onde consta que:

Se a remessa for realizada para o desenvolvimento de armas biológicas ou químicas, a pena prevista no caput será quadruplicada e deverão ser aplicadas as sanções de embargo, suspensão ou interdição parcial ou total do estabelecimento, atividade ou empreendimento, do responsável pela remessa.

Ao aplicar tais mudanças à já existente lei, o Brasil envia uma importante mensagem à nível nacional e internacional de que, apesar da Convenção de Armas Biológicas chegar aos 40 anos de existência, hoje, dadas as constantes ameaças por parte de grupos distintos em obter e desenvolver armas biológicas, é de suma importância que os Estados Parte desta Convenção revisem suas legislações de forma assegurar que tais mecanismos estejam em dia e tais práticas não venham à acontecer.

Encorajo não somente o governo Brasileiro, mas sim todos os demais Estados Lationo-Americanos à continuar sua revisão das leis relacionadas à Convenção de Armas Tóxicas e Biológicas.
